Dealing with Insurance for Disputed Claim

There may be times when you may disagree with your insurance company about your auto insurance claim. If you are not happy with the decision of the auto insurance settlement you have still a few options to dispute the decision. You have a few ways to reason out with your own insurance company about why you disagree with them and find an amicable solution.  Auto insurance companies base their decisions on evidence, so you stand a good chance to get the right sum that you are entitled to.

  1. When your agent does not provide a satisfactory solution, you can get the name and phone number of the claims department head of your insurance company. There may be a consumer complaint cell also which you can approach.
  2. Be sure to carry the necessary documents and evidence that support your claim and tell them why you are not satisfied with their earlier decision.  They will go through the facts and evidence you provide. Do cooperate with the investigation your insurance company. If your insurer differs with the decision of the other driver’s insurance company, it will negotiate with them or take the issue for arbitration to get a final decision. They will make a decision that can protect you from lawsuits.
  3. You can also review your policy to see if there are arbitration or appraisal services available with your insurance company. They can help to settle the differences or dispute you may have with them about your claim settlement.
  4. When you are still not satisfied with the insurance company’s resolution of the dispute, you can seek the help of the insurance department of your state.
  5. You also have the option of calling the toll free number of the National Insurance Consumer Helpline 800-942-4242. You can get your complaint looked into by trained and licensed insurance professionals.
  6. You have the final option of taking the other driver or his auto insurance company to a claims court.  So you can seek the help of an attorney to know your further options.
 Be aware that a few companies may reverse their decision but many others may not. Auto insurance companies cannot base their decisions on their own rules. They are accountable to the legal system and they must base their decisions on legal precedence. So you can always try the above tips before going to court and keep this as the last resort.
