When and why is SR 22 Form Filed

An SR 22 insurance policy is taken to remove a suspension order placed by the DMV on motorist’s driving privilege.   It is a document produced by an insurance provider to prove that a driver has auto insurance. Problem drivers who have been cited for DUI or for driving without license usually require this to get their suspended driver’s license reinstated.  The form SR 22 certifies to the DMV of your state that minimum liability auto insurance has been issued by the auto insurance company.

The proof of having auto insurance is required as per the law of the US without which you cannot operate a vehicle on the roads. Driving without insurance is an offense and therefore the DMV revokes the driver’s license of the problem driver and insists on filing of SR22 Form. It is a way to keep the problem drivers away from roads and to protect others, properties and structures.  Filing SR22 ensures that the driver carries liability auto insurance. The state makes sure that the roads are safe with insurance protection.

The SR 22 Form
The insurance companies file the SR 22 Form with the DMV.  They are allowed to charge the driver a fee of $15 to $25 for filing this proof of financial responsibility for driving on the roads.   The rating factor for this insurance is your driving record which shows your DUI suspension and the premium rate will be higher than usual as they are considered high risk by the insurance companies.

The cost of SR 22 insurance will depend on your driving record, the laws in your state and your driving experience. Depending upon the state laws, the filing process typically takes up to 30 days. The electronic submission if allowed by the state law may be much faster.

How long is SR22 required?
In most of the states you must carry the SR 22 forms for at least three years from the time of suspension revocation of your driver’s license.   If you cancel you policy within this period, the insurance company will notify the DMV in Form SR 26 that you no longer carry the insurance. The period SR 22 is in force is based on the severity of your offense.
